The Dark Side of Background Checks: When They Go Wrong

The Dark Side of Background Checks: When They Go Wrong

“There’s a common, taken-for-granted assumption that background checks are an accurate reflection of a person’s criminal record, but our findings show that’s not necessarily the case,” quotes assistant Professor Robert Stewart of the Department of Criminology and Criminal Justice and Associate Professor Sarah Lageson of Rutgers University in their report Criminology.

Background checks are the first step in hiring employees, or landlords considering possible tenants, or schools approving field trip chaperones, however, these checks are not foolproof. Background check errors can lead to wrongful rejections, lawsuits or compliance nightmares!

Although many businesses trust automated systems, when these systems fail, the consequences can be lethal. When bias sneaks its way into hiring decisions, employment verification risks increase, it's the human oversight in such situations which proves to be the undoing.

Real-Life Cases of Background Check Failures

Thousands of people fall victim to inaccurate background checks every year, through no fault of their own. Damaging information in a background report not only harms reputation and causes embarrassment, it also causes problems such as having a rental application rejected, a loss of a job, and other adverse effects.

The Fair Credit Reporting Act requires that the businesses that provide background checks must use maximum possible accuracy when doing so to avoid damaging the good name of consumers. But problems happen when automated processes are used, records are not updated, and when background check companies use their own classifications to characterize offenses rather than accurately reporting from public records.

Background checks are meant to protect companies, but when mismanaged, they can cost businesses money, reputation, and even legal trouble. Take the case of Wells Fargo. The company faced backlash when it wrongfully terminated employees due to background check errors. Workers were flagged incorrectly, leading to lost jobs and lawsuits against the bank.

Another infamous case involved Uber. The company’s background check provider wrongly identified drivers as having criminal records due to mismatched names. Many drivers lost their jobs unfairly, leading to public scrutiny and legal settlements.

These cases prove only one thing: even the biggest companies aren’t immune to hiring risks when background checks go wrong.

The Role of Human Overview in Preventing Mistakes

Although technology has made the employment verification process faster, but should it be the sole decision maker? Obviously not. Yes, automated systems can process large amounts of data in a short span of time but they can hardly understand the nuances behind that data. On the contrary, a human recruiter possesses insight that is more evolved than any machine’s logical analysis.

If a decade-old minor offense that’s legally irrelevant, presents itself in front of AI, it may flag a candidate. Thus, the candidate loses the job without a manual review. This is why human overview is crucial because machines may analyze faster but humans interpret the nuances.

How Bias Creeps into Background Verification

Bias isn’t always intentional, but it can’t be denied. Many wrongful background check failures stem from flawed data or discriminatory algorithms. AI needs to be trained, it tailors itself according to the data it has been fed with. So, if an AI system is trained on biased historical data, it is likely to unfairly flag certain groups of candidates.

Ensuring a fair hiring process involves auditing hiring technologies to prevent unintended discrimination and providing every candidate with an equal opportunity. Because fair hiring process isn’t just about catching criminals—it’s about giving every candidate an equal chance.
