Background Checks in the Gig Economy: Are Freelancers and Remote Workers Being Left Out?

Background Checks in the Gig Economy: Are Freelancers and Remote Workers Being Left Out?

Employment as is known is slowly dissolving. In this era, a job doesn't specifically refer to a 9 to 5. The traditional employment structure is rapidly evolving with gig workers, freelancers, and remote hires becoming an integral part of the workforce. Companies increasingly rely on them for flexibility and specialized expertise. But while full-time employees often undergo rigorous background screening, many freelancers and remote workers slip through the cracks. Does this create a blind spot in hiring security? Are businesses exposing themselves to unnecessary risks?

There are multiple cases where organizations have suffered due to neglect in hiring remote employees and gig-workers. In this new employment era, it is crucial to explore the nuances of background checks in the gig economy to help businesses implement effective verification strategies.

With the changing employment structures background checks also need to change, but how?

Why Are Background Checks Less Common for Freelancers and Remote Workers?

Before diving into the ‘how’, it is important to understand the ‘why’. Traditional employment verification processes were designed for long-term employees working within a structured office environment. Gig workers, on the other hand, often work on short-term contracts, sometimes for multiple companies simultaneously. The prevailing background check methodologies are not appropriate for freelancers and remote workers as many employers assume that screening isn’t necessary for temporary hires - but is that the real case?

A major reason background checks are less common for gig workers is the misconception that short-term employment equals lower risk. These employees are not part of the physically present working force, don’t interact much with people, and more often than not, they don’t even meet their employers and co-staff members personally! Therefore, the general assumption is that these employees do not require background checks.

Uber, a company that attracts gig workers and provides contract-based employment, faced multiple legal battles due to inadequate background checks on gig workers. In 2018, Uber was fined $8.9 million in Colorado for hiring drivers with criminal records! Imagine the reputational and financial loss the company must have suffered especially for a company that was trying to grow in an already competitive market. This highlights the importance of proper screening, even for contract-based roles.

Freelancers and gig-workers have access to sensitive data, interact with customers, and even represent a company’s brand - just like in the case of Uber.  Whether physically present or not, employers do hand over their confidential data, logistics and other sensitive information to these workers. So, when recruiters won’t hire an in-office employee without checking their credentials, why take that chance with remote workers?

The Risks of Hiring Gig Workers without Verification

In another shocking incident, a Silicon Valley company hired a remote software developer without a background check. The company found out later that the freelancer had misrepresented their experience, leading to a failed product launch. The company suffered terrible financial losses and had to rebuild the project from scratch.

Skipping background checks for freelancers and remote employees can lead to significant financial, operational, and reputational risks.

  • Fraud and Identity Theft
Without screening, companies may unknowingly hire individuals using fake identities or fraudulent credentials. In 2021, a cybersecurity company discovered that a freelancer they hired online was outsourcing tasks to an unauthorized third party, leading to a major data breach.

  • Intellectual Property Theft
Remote workers often have access to confidential business information. In 2020, a major software firm faced legal challenges when a contractor leaked proprietary code to a competitor.

  • Compliance Violations
Many industries have strict compliance requirements (e.g., finance, healthcare). Hiring unverified freelancers can lead to hefty fines and legal repercussions.

  • Misinformation and Brand Damage
Fake qualifications or falsified work experience can result in poor work quality, ultimately affecting the company’s reputation.

Either physical or remote, any employee associated with an organization is a projection of that organization, hence, it is important to hire employees after thorough background verification.

Industries Where Freelancer Background Checks Matter the Most

Freelancers and gig workers are now part of the mainstream industry. The ease that comes with freelancing also curtails inhibitions. While some industries may have leniency when hiring gig workers, others must enforce strict verification processes to mitigate risk.

Misinformation and Brand Damage

  • Finance & Banking
Fraudulent financial advisors or data analysts can lead to major security breaches.

  • Healthcare & Telemedicine
Remote medical professionals must have valid certifications and clean records.

  • IT & Cybersecurity
Unverified remote developers could introduce security vulnerabilities.

Industries with More Flexibility

  • Creative & Marketing
While a portfolio often speaks for itself, verifying work history prevents fraud.

  • Content Writing & Journalism
Plagiarism, misinformation, and ethical concerns make background checks essential.

  • Customer Support & Virtual Assistance
Ensuring reliability and professionalism is crucial for client interactions.

How Companies Can Conduct Background Checks for International Freelancers

A company may be based in America but hire freelancers from Pakistan. The world of freelancing and remote jobs have made it easy to recruit talent from across borders and continents. The only drawback - freelancers working across borders make verification more complex.

  • Identity Verification
Cross-checking government-issued IDs and tax documentation.

  • Credential & Education Checks
Verifying degrees, certifications, and employment history through global databases.

  • Criminal Record Screening
Depending on jurisdiction, some countries provide international criminal background checks.

  • Reputation & Work History Assessment
Checking online reviews, testimonials, and references.

  • Social Media & Digital Footprint Analysis
Assessing online presence to detect red flags.

Conclusion
